This privacy policy explains how Varsity Nine uses any personal information we collect about you when you fill in an application.

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We will collect and use information supplied by you and other users of the website to evaluate if you’re eligible to earn a scholarship in the USA, or are a suitable candidate for our Pro, Tour and Soccer Programme services.

Data Controller

Varsity Nine is the controller and responsible for your personal data (collectively referred to as “we”, “us” or “our” in this privacy policy).

You have the right to make a complaint at any time to the Information Commissioner’s Office (ICO), the UK regulator for data protection issues (www.ico.org.uk). We would, however, appreciate the chance to deal with your concerns before you approach the ICO so please contact us in the first instance.

1. What information do we collect about you?

We collect information about you when you register with us or engage in our services. We also collect information when you voluntarily complete customer surveys, provide feedback, sign up for our newsletter and participate in competitions. Website usage information is collected using cookies.

Without limitation, any of the following data may be collected and stored by Varsity Nine which we have grouped together as follows:

  • Identity Data includes first name, last name, date of birth, place of birth, nationality, occupation and gender.

  • Contact Data includes billing address, delivery address, contact address, email address and telephone numbers.

  • Transaction Data includes details about payments to and from you.

  • Technical Data includes internet protocol (IP) address, your login data, browser type and version, timezone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.

  • Profile Data includes your interests, preferences, feedback and survey responses.

  • Usage Data includes information about how you use our website and services.

  • Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

  • Academic and Sporting history which includes academic grade results and sports performance statistics.

Any or all of the above data may be required from us from time to time in order to provide you with the best possible service and experience when you request to engage in Varsity Nine’s services.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with our services). In this case, we may have to cancel a service you have with us but we will notify you if this is the case at the time.

2. How is your personal data collected?

We use different methods to collect data from and about you through:

  • Direct interactions

  • Automated technologies or interactions. As you interact with our website, we will automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies.

  • Third parties or publicly available sources. We will receive personal data about you from various third parties and public sources as set out below:

Technical data from the following parties:

  • Analytics providers such as Google based outside the UK;

  • Social media platforms such as Meta and TikTok based outside the UK.

  • Contact, Financial and Transaction Data from providers of technical, payment and delivery services such as Stripe, Inc based outside the UK.

3. How will we use the information about you?

We collect information about you in order to evaluate and define if you’re eligible to earn a scholarship in the USA, or are a suitable candidate for our Pro, Tour and Soccer Programme services. If you agree, we will contact you by email, phone or text in order to consult and offer the best advice regarding our services.

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you.

  • Where it is necessary for our legitimate interests (or those of a third party) and your interest and fundamental rights do not override those interests.

  • Where we need to comply with a legal obligation. 

Varsity Nine will not share your information for marketing purposes with companies outside our company.

4. International Transfers

In order to deliver our services, we may send your details to, and also use information from American Universities, athletic associations, academic evaluators, schools and colleges, sports clubs and organisations. As some of these external third parties are based outside the UK, their processing of your personal data will involve a transfer of data outside the UK.  

Whenever we transfer your personal data out of the UK, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data. 

  • Where we use certain service providers, we may use specific contracts approved for use in the UK which give personal data the same protection it has in the UK.

5. Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and applicable regulators of a breach where we are legally required to do so.

6. Marketing

We would like to send you information about services of ours which may be of interest to you. If you have consented to receive marketing, you may opt out at a later date.

You have a right at any time to stop us from contacting you for marketing purposes of Varsity Nine.

Under certain circumstances, you have rights under data protection laws in relation to your personal data we hold about you. This includes:

  • Request restriction of processing your personal data.

  • Request transfer of your personal data.

  • Right to withdraw consent.

If you would like to exercise any of the rights set out above, please contact the DPO. 

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights above). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

8. Data Retention 

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements. 

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

Cookies are text files placed on your computer to collect standard internet log information and visitor behaviour information. This information is used to track visitor use of the website and to compile statistical reports on website activity.

10. Our Third Party Data Processors

We use a number of third parties to process personal data on our behalf. These third parties have been carefully chosen. We do not allow our third party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions. 

Our website contains links to other websites. This privacy policy only applies to this website so when you link to other websites you should read their own privacy policies.

11. Data Breaches

We will report any unlawful data breach of this website’s database or the database(s) of any of our third party data processors to any and all relevant persons and authorities within 72 hours of the breach if it is apparent that personal data stored in an identifiable manner has been stolen.
